WOT COMMERCIAL LICENSE,
Version 1, 20 January 2006
  1. Definitions

WOT - Web Orientated Technologies Ltd.
OSI - Open Source Initiative (http://www.opensource.org/)
    GPL - Gnu Public License

  2. Terms and Conditions

The WOT Commercial License is an agreement with WOT for organizations that do not want to release their application source code. Commercially licensed users are also free from the requirement of making their own application open source.

When your program is not licensed under either the GPL-compatible Free Software License as defined by the Free Software Foundation or approved by OSI, and you intend to or you may distribute the contextMenu program, you must first obtain a commercial license per installable instance.

Typical examples of distributed, installable instances include:

    • Selling software that includes contectMenu to customers who install the software on their own machines.
    • Selling software that requires customers to install contextMenu themselves on their own machines.

    Specifically:

    • If you develop and distribute a commercial application which includes contextMenu you need a WOT Commercial License per installable instance of contextMenu.

GPL users have no direct legal relationship with WOT. The WOT Commercial License, on the other hand, is WOT's private license and provides a direct legal relationship with WOT.

If you represent a non-profit organization or an academic institution, it is recommend you publish your application as an open source/free software project using the GPL license. In which case you will be able to use contextMenu free of charge under the GPL.

If you are a private individual you are free to use contextMenu for your personal applications provided you do not distribute or profit from them. If you do distribute but do not profit from them, you must make a decision between the WOT Commercial License and the GPL. If you do profit from them you are required to purchase a WOT Commercial License per installable instance.

Please note that even if you ship a free demo version of your own application, the above rules apply.

An exception to the fees associates WOT Commercial License is when installed instances exist on a machine that is accessed by a single user at a time and is within an environment which has restricted access to individuals within your organisation. For example no fee is required within a development environment when the installed instance is accessed by the developer while writing software. However, a commerical license would be required per internal environment accessible by more that single user or system such as a QA environment.
